Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Card Pulse Beacon and its website, web application, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and Accounts

You must be legally able to form a binding agreement to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate account information and keep it up to date.

3. Service Description

Card Pulse Beacon provides tools for search, watchlist management, price monitoring, and alerts related to trading card products and related marketplace listings. Features may change over time, and availability may vary by region, account type, or technical constraints.

4. Acceptable Use

You agree not to, and not to assist others to:

  • use the Services for unlawful, fraudulent, or abusive conduct;
  • interfere with or disrupt the Services, infrastructure, or security controls;
  • attempt to gain unauthorized access to accounts, systems, or data;
  • scrape, crawl, harvest, or bulk-extract data beyond permitted use, or use automated means to access the Services in a manner that sends more requests than a human could reasonably produce in the same time period;
  • bypass, disable, or circumvent rate limits, paywalls, access controls, or other protections;
  • reverse engineer, decompile, or attempt to derive source code or underlying ideas of the Services except where prohibited by law;
  • upload, transmit, or introduce malware, exploits, or other harmful code.

5. User Content and Feedback

You may submit content such as feedback, messages, preferences, and other information you choose to provide ("User Content"). You retain ownership of your User Content, but you grant Card Pulse Beacon a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and use your User Content solely to operate, maintain, secure, and improve the Services.

You represent and warrant that you have all rights necessary to submit User Content and that your User Content does not violate any law or infringe any third-party rights.

6. Third-Party Services and Data

The Services may display or reference third-party data, listings, and links (for example, marketplace listings). We do not control third-party services and are not responsible for third-party content, policies, pricing, availability, or actions.

Your use of third-party services is subject to those services' terms and policies, and you are responsible for complying with them.

If you sign in with Google, your use of Google Sign-In is also subject to Google's applicable terms and privacy policies. Google provides authentication information to Card Pulse Beacon and our authentication provider so we can create and secure your account.

Some eBay listing data is provided through eBay APIs and is shown only within the Services so you can search and browse eBay listings. Your right to view eBay content through the Services is limited, non-transferable, and revocable. eBay is a third-party beneficiary of these eBay-related terms and may enforce them directly.

You may not use eBay content from the Services to scrape, harvest, bulk download, redistribute, mirror, train artificial intelligence systems, create competing services, suggest or model prices for items listed on eBay, or otherwise use eBay content outside the Services. You do not receive programmatic control over eBay APIs, and all eBay API calls made through the Services are made by Card Pulse Beacon under its eBay application keys.

eBay content and API access are also subject to eBay's applicable terms and policies, including the eBay API License Agreement.

7. Data Accuracy and No Investment Advice

Pricing and listing information may be delayed, incomplete, or inaccurate. The Services are provided for informational and product utility purposes only and do not constitute financial, investment, legal, or tax advice.

You are solely responsible for evaluating listings and making any purchasing, selling, or other decisions.

8. Intellectual Property

Card Pulse Beacon and its associated software, branding, and original content are owned by Card Pulse Beacon or its licensors and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms, no rights are granted to you.

You may not use Card Pulse Beacon trademarks, logos, or branding without our prior written consent.

9. Service Availability and Changes

We may update, modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for service interruptions, feature changes, or downtime.

10. Termination

We may suspend or terminate your access to the Services if you violate these Terms or if your use creates risk or potential harm to the Services, other users, or third parties. You may stop using the Services at any time.

Sections that by their nature should survive termination will survive (including Sections 5-14).

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARD PULSE BEACON AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Card Pulse Beacon and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms or applicable law.

14. Governing Law; Venue

These Terms are governed by the laws of the United States and the laws of the state in which Card Pulse Beacon operates, without regard to conflict-of-law principles.

You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the applicable state or federal courts located in that state, unless mandatory arbitration or other dispute resolution rules apply in your jurisdiction.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide any notice required by law. Continued use of the Services after updated Terms become effective constitutes acceptance.
